No Guarantee of Employment
Sober Work helps match candidates with employers and job opportunities, but does not guarantee employment, interviews, or any specific outcome.
Independent Contractor Status, Liability & Indemnification
1. Independent Contractor Relationship; No Employment by Sober Work. Sober Work is a job-matching and referral service. Sober Work does not employ, supervise, direct, or control the manner, means, method, or details of any work performed by individuals referred through the platform ("Workers") for businesses that engage them ("Client Businesses"). Workers referred through Sober Work are independent contractors of, or employees of, the Client Business — not employees, agents, or representatives of Sober Work. Sober Work does not set a Worker's pay rate, work schedule, work methods, or performance standards; these are determined solely between the Worker and the Client Business.
2. No Guarantee of Work Performance, Quality, or Outcome. Sober Work does not guarantee the quality, timeliness, safety, skill, or completion of any work performed by a Worker, and does not warrant that any Worker is fit for a particular job or task. Client Businesses are solely responsible for evaluating a Worker's fitness for a specific role and for directing and supervising work performed on their premises or projects.
3. Client Business Responsibilities. Client Businesses engaging a Worker through Sober Work are solely responsible for: (a) directing and supervising the Worker's day-to-day work; (b) complying with all applicable federal, state, and local employment, wage-and-hour, workers' compensation, and workplace-safety laws applicable to the Worker, including obtaining any required workers' compensation insurance or equivalent coverage; (c) providing a safe work environment and any required safety training, supervision, or equipment; and (d) independently verifying any qualifications, licensure, or certifications required for the work.
4. Assumption of Risk. Workers and Client Businesses acknowledge that work referred through Sober Work may involve physical labor and inherent risks of injury or loss. By using the platform, Workers and Client Businesses assume the risks associated with the work performed and agree that Sober Work is not responsible for injuries, property damage, or losses arising from work performed by a Worker at or for a Client Business.
5. Indemnification. To the fullest extent permitted by law, Workers and Client Businesses agree to indemnify, defend, and hold harmless Sober Work, its officers, directors, employees, and affiliates from and against any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising out of or related to: (a) work performed or not performed by a Worker; (b) any injury, property damage, or loss occurring at or arising from a job site; (c) a Client Business's failure to comply with applicable employment, wage-and-hour, or safety laws; or (d) any breach of these Terms.
6. Limitation of Liability. To the fullest extent permitted by law, Sober Work's total liability arising out of or related to the platform, any referral, or any work performed by a Worker shall not exceed the fees paid to Sober Work in the preceding 12 months (currently $0, as Sober Work does not charge fees to Workers or Client Businesses). In no event will Sober Work be liable for indirect, incidental, consequential, special, or punitive damages, including lost profits or lost wages.
7. Screening & Vetting Disclaimer. Sober Work may interview Workers and gather information as part of its matching process. This process is not a comprehensive background check. Sober Work does not warrant or guarantee a Worker's criminal history, driving record, sobriety status, or fitness for any specific job. Client Businesses are encouraged to conduct their own due diligence before engaging a Worker.
